kernel-2.6.38 & ATI Graphics card [SOLVED]

Hoping to get a little help upgrading kernels.  I haven't been able to upgrade to kernel 2.6.37 or 38.  After installing the kernel and rebooting the fglrx module fails to build.  Trying to install manually fails also.  

Cpu is AMD Turion(tm) X2 Dual-Core Mobile RM-72
with
ATI Technologies Inc RS780M/RS780MN [Radeon HD 3200 Graphics] (prog-if 00 [VGA controller])

Here's the contents of the fglrx-install.log from one of the kernel install attempts.  All kernels except 33, which I'm on now, produce the same error when trying to install the video driver.

Creating symlink /var/lib/dkms/fglrx/8.831.2/source ->
                 /usr/src/fglrx-8.831.2

DKMS: add Completed.

Preparing kernel 2.6.38.2-pclos1.pae for module build:
(This is not compiling a kernel, just preparing kernel symbols)

make prepare.....

cd /var/lib/dkms/fglrx/8.831.2/build; sh make.sh --nohints --uname_r=2.6.38.2-pclos1.pae --norootcheck.....(bad exit status: 1)
[Error] Kernel Module : Failed to build fglrx-8.831.2 with DKMS
[Error] Kernel Module : Removing fglrx-8.831.2 from DKMS

completely from the DKMS tree.

did you used the amd driver from synaptic or did you downloaded it from amd?

Tried both the synaptic and ATI version on the first attempt.  Stuck with the ATI version for the other attempts.

so you mixed versions? did you removed the one you installed first?

the drivers installed by hand won't work with newer kernels, that is why you need to use only drivers from repos

after each new kernel you need to install the driver downloaded again

Ok.  Should this plan work

reboot to safe mode
uninstall ATI version
install kernel
install fglrx (there were several in the repo , not sure which to install)
reboot select new kernel

you need the fglrx that says 8. something, read carefully, it mentions what package is required to install the control center for the video card
