Thus results from a jurisdiction with different laws cannot be used as a basis for an argument in another jurisdiction's court proceedings.

And I don't think they will try to do it but they will use it in newspapers and TV to influence public opinion and put pressure on the courts.

I have no doubt you are right  ;)

...  but I was commenting on this, which is contrary to how I understand court proceeding operate .....

So yes, whilst you're technically right, each national laws to their own in these cases. They can use those positive judgments as a basis or foundation to argue in other parts of the world.

It is very good to see, "the Mexican judiciary strict enforcement of law in defense of an SME against a giant such as Apple."
I'm wondering how this applies on a Global stage, could Apple go to the U.S. and sue iFone, for the same trademark dispute ?

As with Apple vs. Samsung, a English judge said Samsung had not 'copied' the look of Apple's iPhone, whereas a German judge (from memory) fined Samsung, for copying, after the English decision ?

Very confusing, in 3003 ;D

I don't know what you had in mind when mentioning Global Stage ......  USA law applies to the US and other countries have their own laws.

If any corporation is operating in a country then they must abide by that country's laws.

A suit in the USA would only be applicable if both companies are operating in the USA.

Is iFone operating in the USA?
OK, thanks. That makes obvious practical sense. With so many Mega Tech Companies doing Business in so many countries, about some very petty issues it's a very messy picture. Great time to be a Lawyer.  :D

Guys ... read the comments to this article that Crow posted. They are PRICELESS! Some of them had me laughing so hard, I about fell out of my chair (especially the one that likened Apple's lawyers to monkeys throwing ... nah ... just go read the comments).

Yep, good comments, I liked the monkey one  ;D (no Joechimp, we're not talking about you   ;) ), also I liked this one and I think never was better used "the chickens coming home to roost........."

It seems the pendulum is going the other way since Apple was hand slapped in UK for trying to cheat with the Court Order and Samsung has a good chance to win appellation in USA; besides, people fired in Apple is a signal of problems in paradise.

Let's see, in the last year or so they sued a little coffee chop in Germany and a small school in Canada over the logo, failed to comply the Court Order in UK, went through a lost battle in México against iFone, fired high executives in Apple because they didn't follow CEO orders (I think the maps were released against the advise of people in charge and consequently they didn't want to assume that responsibility) and (last but not least) went through the "map disaster".

Apple may be doing fine in Wall Street but that is gambling luck and may end in one minute, Judges don't like bullies and a Judge just tell them about it, if Apple start to lose  and it makes a bad name in Courts, shares may go down and the Company will shrink under the attack of Android devices.

iFone continues and presented the demand for compensation against Apple and others (Telcel, Movistar and Iusacell) accusing them of complicity

Don't forget the a.pl suit.  That was sure to confuse everyone with Apple

iFone vs iPhone: another round.

Apple lost a constitutional protection against the sentence of a Judge and will have to pay
